This Warranty Policy regulates the conditions for granting and exercising warranty rights for products purchased from the Company (DAISY MEDICAL S.R.L. and DAISY PET S.R.L.) through the Site. The document is drawn up in accordance with applicable Romanian legislation, Government Emergency Ordinance no. 140/2021 and Government Ordinance no. 21/1992.
The legal conformity warranty is the mandatory, free and implied warranty offered by the Company, which ensures that the goods correspond to the descriptions, qualities and purpose for which they were designed.
For individual consumers, the legal warranty period is 2 (two) years from the date of delivery of the goods, and any non-conformity identified within 1 (one) year from the date of delivery is presumed to have existed at the time of delivery.
The commercial warranty, in accordance with Government Emergency Ordinance no. 34/2014, represents any additional commitment assumed by the Company or the manufacturer towards the consumer, which goes beyond the legal obligations of the conformity warranty. This is a promise to refund the price, replace, repair or maintain the products, if they do not correspond to the specifications in the warranty declaration or in the relevant advertising, without necessarily being an issue related to legal conformity. The commercial warranty is specified in a separate Warranty Certificate (if applicable) and complements, without canceling, the legal warranty.
In order to benefit from warranty services, the Buyer is obliged to present the claimed product together with the Warranty Certificate (if applicable), the payment document proving the purchase (fiscal invoice, fiscal receipt or cash receipt), appropriate packaging to ensure safe transport to the service unit, and all accessories received at the time of purchase.
In the event of a non-conformity, the Buyer has the right to request, according to their choice and in order of priority, the repair or replacement of the goods, at no additional cost and within a reasonable time. Any corrective measure requested under the warranty will be resolved and completed within a maximum of 15 calendar days from the date on which the Company or the service unit took possession of the claimed goods, in accordance with Government Emergency Ordinance no. 140/2021.
In the event that the non-conformity cannot be remedied by repair or replacement within the legal period of 15 days, or if the same non-conformity reappears after the remediation attempt, the Consumer has the right to request a proportional reduction of the price or termination of the contract (rescission), with full reimbursement of the amounts paid.
If the non-conformity is confirmed and covered by the warranty, the transport costs (round trip) to and from the service unit are borne entirely by the Company. In the event that the product proves to be conforming or the defect is caused by improper use (a situation which leads to the loss of warranty), the Buyer shall bear the transport costs.
The legal warranty period is extended by the period elapsed from the moment of notification of the non-conformity until the date on which the goods were restored to working order and effectively handed over to the Buyer, an extension which will be recorded on the Warranty Certificate.
In the event that a non-conformity is reported within the first 24 hours of purchasing/receiving the goods, the Company undertakes to proceed with its immediate replacement, if the product is available in stock.
In its relationship with legal entity Buyers, the Company is exempt from liability for manufacturing defects or shortcomings of goods delivered in original sealed packaging, as these are the responsibility of the Manufacturer. In its relationship with individual Consumers, the Company assumes full responsibility for the conformity of the goods at the time of sale, in accordance with consumer protection legislation, regardless of the nature of the packaging.
The Company is exempt from liability regarding the legal conformity warranty or the commercial warranty in situations where the defect of the goods is caused by improper use or use for purposes other than those for which it was designed, or due to unauthorized interventions by unqualified persons. The warranty does not cover defects caused by failure to comply with periodic calibration protocols, the use of incompatible consumables, or the operation of equipment outside the technical parameters specified by the manufacturer.
Furthermore, the warranty does not cover damage resulting from mechanical, thermal or electrical shocks (voltage fluctuations) or other external causes, including inadequate maintenance.
